About these terms
“Owl” means our apps for iPhone and Android (including Kids mode), the website owlbell.com, and the services they provide. By creating a family, joining one, or using Owl, you agree to these terms. If you don't agree, please don't use Owl.
You must be at least 18, or the age of majority where you live if that's higher, to create a family or join one as an adult. Owl is for personal and family use, not for running a business. We offer Owl in the United States.
Your account and your family
- The account holder creates the family and controls it: who is in it, which children each adult can see, what each adult can do, and whether the family continues.
- Children you add. By adding a child, you confirm that you are their parent or legal guardian, or that you have their parent's or guardian's permission to organise their day in Owl.
- Adults you invite agree to these terms when they join. You're responsible for choosing what they can see and do, and for removing access when it should end. For babysitters, you can set an end date.
- Keep your account secure. Don't share your sign-in codes, and lock the app if other people use your phone. Tell us straight away at support@owlbell.com if you think someone else has accessed your account.
- Please keep your information accurate, especially your email address, because that's how you sign in and how we contact you.
Children and Kids mode
Children can't create an account. A child uses Owl only through Kids mode on a device their parent pairs with the family, and only after the parent has given the consent described in our Children's privacy notice.
As the parent, you accept these terms on your child's behalf and are responsible for how your child uses Owl. Please explain to your child what Kids mode does and which features you've turned on.
Safety features are not an emergency service
Owl is not an emergency service and must not be relied on in an emergency. If someone is in danger, call 911 in the US, or 999 or 112 in the UK.
- Location, arrival and departure notes, check-ins, help alerts and reminders depend on things we don't control: the device being on and charged, its permissions and settings, network and GPS signal, and Apple's and Google's services. They can be late, inaccurate or missing.
- Owl helps families stay organised and informed. It isn't a substitute for supervising children or for your own judgement.
- Screen-time controls rely on the permissions Apple and Google give apps. Children can sometimes get around them, and they may stop working after device updates. They support your family's rules; they don't guarantee them.
- Leave-by times and drive times are estimates. Traffic, weather and other conditions can change them.
- Please don't rely on Owl alone for anything where a missed reminder could cause harm, such as a child's medication.
AI features
Owl can read messages you add and suggest dates, items and payments, answer questions about your plans, and carry out voice commands. These features use automated processing, including artificial intelligence, and can make mistakes: a wrong date, a missed item, a misheard word.
- Owl shows you what it understood and adds nothing until you confirm it. Please check before you confirm.
- Suggestions aren't medical, legal, financial or safety advice.
- You're responsible for what you choose to add to your family's plans.
Your content
“Your content” is everything you and your family add to Owl: plans, notes, photos, documents, messages and so on. You own it.
- You give us permission to store, copy, process and display your content only as needed to run Owl for your family, including through our service providers. This permission ends when your content is deleted, subject to the backup and legal retention periods in our Privacy policy.
- You must have the right to add what you add. This includes other people's details, such as a coach's contact information or a message from a group chat, and you should use them only to organise your family's plans.
- Don't add anything illegal, or anything that infringes someone else's rights.
- We don't routinely look at your content. We may remove content, or act on an account, if we're told about content that breaks these terms or the law.
Acceptable use
When you use Owl, you must not:
- use Owl to monitor, track or locate anyone without their knowledge, or any adult without their consent, or to stalk, control or harass anyone;
- add a child who isn't yours to care for, or keep an adult in your family after their right to see a child has ended;
- break the law, or help anyone else to;
- try to get into accounts, families or data that aren't yours, or test or attack Owl's security;
- copy, scrape, resell or build a competing service from Owl, or reverse engineer it except where the law allows you to;
- interfere with Owl, overload it, or get around its limits or safety features;
- pretend to be someone else.
Subscriptions, trials and cancelling
Owl's core features are free. Family Plus is a paid subscription that covers everyone in your family. It's sold through Apple's App Store or Google Play. The price in your country, including any tax, is shown before you buy. When we launched it was $49.99 a year or $6.99 a month in the US.
- Automatic renewal. Your subscription renews automatically at the end of each period, and you're charged by Apple or Google, until you cancel.
- Free trial. Family Plus includes a 14-day free trial. If you don't cancel at least 24 hours before the trial ends, it turns into a paid subscription and you're charged. We remind you before your trial ends, and before each yearly renewal.
- Cancelling. You can cancel any time in your Apple ID or Google Play subscription settings. Owl explains how in Settings, Subscription. Family Plus stays on until the end of the period you've paid for.
- Refunds. Apple and Google handle payments and refunds under their own policies, and you can ask them for one. This doesn't affect your legal rights.
- Price changes. If we change the price, we'll tell you in advance. Where the law or the store requires it, the new price applies only if you agree. Otherwise you can cancel before it applies.
Payment reminders
Owl reminds you about payments you owe to schools, clubs and others, but it doesn't make or receive those payments. You remain responsible for paying them, and for checking amounts and due dates with the organisation.
Changes to Owl and to these terms
We're always improving Owl, so features may change. If we remove something you pay for, or change these terms in a way that affects you significantly, we'll tell you at least 30 days in advance, unless we have to act sooner for legal or safety reasons. If you don't agree with a change, you can stop using Owl and delete your account before it takes effect.
Ending or suspending your use
- You can stop using Owl and delete your account at any time. See Delete your account. Deleting your account doesn't cancel a subscription with Apple or Google; please cancel that in your store settings.
- We may suspend or end your access if you seriously or repeatedly break these terms, if we must by law, or to protect a child or anyone else from harm. Where it's safe and lawful, we'll tell you why and give you a chance to respond or download your data first.
- If we ever decide to stop offering Owl, we'll give you at least 60 days' notice and a way to download your data.
Owl's intellectual property
Owl's apps, website, design, name and owl logo belong to us or our licensors. We give you a personal, non-transferable, non-exclusive licence to use Owl for your family under these terms. If you send us feedback or ideas, we may use them without owing you anything, but we'll never publish your name or family details with them without your permission.
Other companies' services
Owl works with services from other companies: Apple and Google (the app stores, payments, notifications and speech recognition), mapping services, and the service providers listed on our Service providers page. When you use a feature that hands you over to another company's service, such as opening directions in Apple Maps or Google Maps, that company's terms apply to it.
If you got Owl from the App Store
If you downloaded Owl from Apple's App Store, the following also applies:
- These terms are between you and us, not Apple. We, not Apple, are solely responsible for Owl and its content.
- Your licence to use the Owl app is limited to Apple-branded products that you own or control, as allowed by the Usage Rules in the App Store Terms of Service. It may also be used by other accounts linked to you through Family Sharing.
- We alone are responsible for maintaining and supporting the app. Apple has no obligation to provide any maintenance or support for it.
- If the app fails to meet any applicable warranty, you may tell Apple, and Apple will refund the purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to meet a warranty are our responsibility.
- We, not Apple, are responsible for addressing any claims by you or anyone else relating to the app or your possession or use of it. These include product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If anyone claims that the app, or your possession or use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
- Our name and contact details for questions, complaints or claims about the app are in Contact us below.
- You must follow any third-party terms that apply when you use the app, such as your mobile network provider's.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
If you got Owl from Google Play, Google Play's terms also apply to your purchase.
Our responsibility to you
What we promise
We provide Owl with reasonable care and skill, and we'll do our best to keep it available and working. Because Owl depends on devices, networks and other companies' services, we can't promise it will always be available, error-free or on time.
If you're in the US
To the fullest extent the law allows, Owl is provided “as is” and “as available”, and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. To the fullest extent the law allows, we're not liable for indirect, incidental, special, consequential or punitive damages, or for lost data or profits. Our total liability for any claim relating to Owl is limited to the greater of the amount you paid for Owl in the 12 months before the claim, or US$50. Some states don't allow some of these limits, so they may not apply to you.
What we never limit
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law doesn't allow us to limit or exclude. Nothing in these terms affects your legal rights as a consumer.
Disputes and the law that applies
- Talk to us first. Most problems can be sorted out quickly. Email support@owlbell.com and we'll try to resolve your concern within 30 days.
- US: if you live in the US, these terms are governed by the laws of the State of [State] and applicable federal law, without regard to conflict-of-laws rules, except where the law of your state requires otherwise. You may bring a claim in the small claims court where you live if it qualifies, or otherwise in the state or federal courts located in [State].
General
- These terms, with the Privacy policy and Children's privacy notice, are the whole agreement between you and us about Owl.
- If a court decides part of these terms can't be enforced, the rest still applies.
- If we don't enforce a right straight away, we can still enforce it later.
- You can't transfer your rights under these terms to anyone else. We may transfer ours to another organisation that takes over Owl. We'll tell you, and it won't reduce your rights.
- We'll contact you by email or in the app. You can contact us using the details below.
